WE SWIM Life is better when we swim We Swim is inspiring parents across Australia to take action to ensure their children enjoy all the benefits of swimming.

Introduction

The We Swim campaign is a national initiative of Royal Life Saving that seeks to increase swimming and water safety skills of Australian children in order to prevent drowning and increase participation in safe aquatic activity.

The campaign provides parents across Australia with a call to action to ensure their children enjoy all the benefits of swimming, from the fun stuff like splashes, dives and races to the many health and safety benefits of being in, on and around the water.

The campaign aim is to ensure all children stay in lessons long enough to achieve and exceed the national benchmark for swimming and water safety to swim continuously for 50 metres and float  for 2 minutes in deep water by 12 years of age.

Eligibility

All interested parties including aquatic facilities, swim schools, aquatic industry organisations, schools, and other like-minded organisations.

Process

  1. Register as a We Swim Campaign Supporter: https://www.WeSwim.com.au
  2. Access Phase 1 Campaign resources upon initial registration (December 2021)
  3. Receive ongoing communications with updates and availability of new campaign resources
  4. Coordinate rollout in line with national rollout plan including additional phases
  5. Supporters may access resources via national supporters and/or RLS State and Territory Member Organisations.

Definitions

  • Campaign Supporter is the organisation agreeing to the conditions and using the resources and associated intellectual property associated with the We Swim campaign, its logo, its key messages and associated Intellectual Property.
  • Campaign means the Properties that collectively make up the We Swim campaign including all associated Intellectual Property.
  • Properties means the products and processes which incorporate the use of Intellectual Property
  • RLSSA means Royal Life Saving Society - Australia
  • Intellectual property means but is not limited to the trademarks, patents, copyright, processes, know-how, registered designs or other like rights, in the Properties.

License

Subject to these Conditions, RLSSA grants to the Campaign Supporter a royalty-free, non-exclusive, non-transferable and non-assignable license for the purpose of using the Intellectual Property solely for the purpose of conducting the Campaign and using the Properties in and for the Campaign. The Campaign Supporter must not use the Intellectual Property for any purpose other than as outlined in this clause.

Obligations

The Campaign Supporter must:

  1. Not use, authorise, sell, assign, sub-license or charge, in any way, all or part of, the Campaign or the Properties under these Conditions, to another party without RLSSA’s prior written consent;
  2. Use the Properties only in relation to the Campaign;
  3. Not use or seek to register any intellectual property, including but not limited to trademarks, business, company, domain or trading names, which contain or are similar to or substantially similar to or so nearly resemble the Properties, as to be likely to cause deception or confusion;
  4. Not use or permit to be used the Properties together with any other program or the name or logo of any third party without RLSSA’s prior written consent;
  5. At all times comply with all relevant laws, rules and requirements of any applicable body or authority and any advertising standards or similar conduct relevant thereto;
  6. Not conduct the Campaign or use the Properties in a manner which is likely to cause harm to the goodwill attached to RLSSA, the Campaign or the Properties;
  7. In no way prejudice the proprietary rights of RLSSA to the Properties and Intellectual Property and at all times protect the value in the Properties and Intellectual Property and ensure that the rights and title of RLSSA are not damaged or infringed in any way by the use of the Properties and Intellectual Property;
  8. Not deface, tarnish, mark or devalue the design content of the Properties and Intellectual Property;
  9. Comply with such directions as may be issued by RLSSA from time to time in its sole discretion in relation to the conduct of the Campaign and/or use of the Properties; and,
  10. Maintain policies and procedures that comply with relevant jurisdictional laws and regulations in relation to the protection of children and young people.
  11. Deliver the Campaign in line with current Campaign documentation;
  12. Use the We Swim logos on promotional material distributed by the Campaign Supporter in relation to the We Swim campaign;
  13. Seek prior permission for the use of RLSSA and/or We Swim logos or any logo or other Intellectual Property of RLSSA on all extraordinary promotional and program related materials, such approval not to be unreasonably withheld by RLSSA;
  14. Not state or imply that the Campaign Supporter conducts RLSSA courses or programs other than those contained within these Conditions or any other separate legal agreement with RLSSA or its state or territory member organisations;
  15. The Campaign Supporter must do all things reasonable to protect the Intellectual Property
  16. If the Campaign Supporter becomes aware of any suspected or threatened infringement, passing off, unfair competition or the like in relation to the Intellectual Property; or any third party alleges or claims that any of the Intellectual Property is liable to cause deception or confusion to the public then the Campaign Supporter must immediately notify RLSSA, giving particulars and providing all necessary information to and as requested by RLSSA.
